Types of personal data we collect about the user

We may collect personal identification information from Users in a variety of ways, including:

This will include Contact and Identity Data. We process this information on the basis of performance of our contract with the User.

This will include managing payments, fees and charges and collecting and recovering money owed to us. This will include Identity, Contact, Financial, Transaction and Marketing and Communication Data. We process this information on the basis of performance of our contract with the User and it being necessary for our legitimate interest of being able to recover funds due to us.

  • To improve our Site

We continually strive to improve our website offerings based on the information and feedback we receive from Users. This will include Technical and Usage Sata and is necessary for our legitimate interests to define types of customers for our products and services, to keep our website updated and relevant, to develop our business and to inform our marketing strategy.

  • To improve customer service and manage our relationship with the User

Users’ information helps us to more effectively respond to Users’ customer service requests and support needs and to be able notify a User about changes to our terms or privacy policy. This will include Identity, Contact and Marketing and Communications Data. We process this information on the basis of performance of our contract with the User, to comply with our legal obligations and it being necessary for our legitimate interest of keeping our records updated and to manage our relationship.

  • To administer content, promotion, survey or another Site feature

To send Users information they agreed to receive about topics we think will be of interest to them. This will include Identity, Contact and Marketing and Communications Data. We process this information on the basis of performance of our contract with the User and it being necessary for our legitimate interest of understanding how customers use our products/services, to develop them and grow our business.

  • To send periodic emails

The email address Users provide will only be used to respond to their inquiries, and/or other requests or questions. This will include Identity, Contact and Marketing and Communications Data. We process this information on the basis of performance of our contract with the User and it being necessary for our legitimate interest of managing our relationship with the User. If Users decide to opt-in to our mailing list, they will receive emails that may include company news, updates, related product or service information, etc.

  • To administer and protect our business and this website

This includes troubleshooting, data analysis, testing, system maintenance, support, reporting and hosting of data. This will include Identity, Contact and Technical data and is necessary for our legitimate interest of running our business, provision of administration and IT services, network security, to prevent fraud.

Opting out of marketing 

If at any time Users would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email or Users may contact us via our Site.

If Users opt out of receiving marketing communications, Users will still receive service-related communications that are essential for administrative or customer service purposes.

International transfers

We share your personal data within the Flexicon Corporation. This will involve transferring your data outside the United States to our overseas offices in Europe, Australia and South Africa.

Whenever we transfer your personal data out of the UK to countries which have laws that do not provide the same level of data protection as the UK law, we always ensure that a similar degree of protection is afforded to it by ensuring that the following safeguards are implemented. Data Retention 

We will only retain Users’ personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain Users’ personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with them.

By law we have to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for six years after they cease being customers for tax purposes.

Users’ Legal Rights

Users have the right to:

  • Request access to personal data (commonly known as a “subject access request”). This enables Users to receive a copy of the personal data we hold about them and to check that we are lawfully processing it.
  • Request correction of the personal data that we hold. This enables Users to have any incomplete or inaccurate data we hold about them corrected, though we may need to verify the accuracy of the new data Users provide to us.
  • Request erasure of personal data in certain circumstances. This enables Users to ask us to delete or remove personal data where there is no good reason for us continuing to process it. Users also have the right to ask us to delete or remove personal data where they have successfully exercised the right to object to processing (see below), where we may have processed a User’s information unlawfully or where we are required to erase personal data to comply with local law.     • Where our use of the data is unlawful but Users do not want us to erase it;

    • Users have objected to our use of data but we need to verify whether we have overriding legitimate grounds to use it.

Users will not have to pay a fee to access their personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if a User’s request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with a User’s request in these circumstances.

We may need to request specific information from the User to help us confirm the Users’ identity and ensure their right to access their personal data (or to exercise any of their other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact the User to ask for further information in relation to the request to speed up our response.

We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if a User’s request is particularly complex or the User has made a number of requests. In this case, we will notify the User and keep them updated.
